LUANA Retreats Terms and Conditions

These terms apply to every retreat, trip, and event booked with Rena Palumbo Creations LLC, doing business as LUANA Retreats ("LUANA," "we," "us," "our"). "You" means the guest making the booking and any guest you book for. By paying a deposit or any other amount, by any method, you confirm you have read and agree to these terms.
1. Booking and Deposit
Your spot is held once we receive your deposit. The deposit and every payment after it are non refundable in all cases. We use your payments right away to secure venues, staff, and transport on your behalf. We may decline any booking at our discretion.
2. Participant Agreement
Every guest must sign our Participant Agreement and Release of Liability. We send it when you book. You agree to sign it within 7 days of booking. Your spot is not confirmed until you do. If you do not sign, we may cancel your booking, and payments already made will not be refunded.
3. Payments
The price and payment schedule shown on your retreat's booking page or in your Participant Agreement apply to your booking. These terms cover payments made through WeTravel, bank transfer, or any other method. All prices are in US dollars. You are responsible for any bank, card, or currency fees. If a payment is more than 7 days late, we may cancel your booking and release your spot. Payments already made will not be refunded.
4. Cancellations by You
All payments are non refundable. This includes the deposit, payment plan installments, add ons, and the final balance. This applies no matter the reason, including illness, injury, pregnancy, work, family matters, visa problems, or travel disruption. Arriving late, leaving early, or skipping any part of the retreat does not qualify for a refund or credit. If you cancel while on a payment plan, any remaining balance due within 60 days of the retreat start date is still owed. To cancel, email flow@luanaretreats.com.
5. Transfers
If you can't attend, you may transfer your spot to another woman with our written approval. Finding a replacement is your responsibility. She must be approved by us, accept these terms, sign the Participant Agreement, and take over any remaining payments on your schedule. You stay responsible for your booking and its payments until she has signed and made her first payment. We do not refund any money to you in a transfer. Payments you already made stay on the booking, and any money between you and your replacement is settled privately between the two of you. A transfer fee of $150 USD applies, paid by you before the transfer is confirmed. Transfer requests must reach us in writing at least 30 days before the retreat starts. Approval is at our sole discretion.
6. Payment Disputes
You agree not to file a chargeback or payment dispute for any charge that follows these terms. If you do, you are responsible for our costs in responding, including dispute fees and reasonable attorney fees.
7. If We Cancel
We may cancel a retreat for any reason, including low enrollment, safety concerns, or venue issues. If we do, you choose one of two options. A refund of everything you paid to LUANA, or a credit for the same amount toward a future retreat. Credits expire 18 months after they are issued. This is your only remedy. We are not responsible for flights, visas, insurance, or any other costs you booked on your own.
8. Changes to the Retreat
Weather, ocean conditions, safety, venue issues, and group needs can force changes. We may change the schedule, activities, meals, instructors, hosts, room assignments, accommodation, or venue and replace them with something of similar value. Rooms may be shared. Changes like these do not qualify for a refund or credit.
9. Events Outside Our Control
We are not liable for any failure, delay, or change caused by events outside our control. That includes natural disasters, severe weather, illness outbreaks, government action, civil unrest, strikes, and transport failures. If an event like this stops the retreat from running, we will offer a credit for the amounts we are able to recover from our suppliers.
10. Travel Insurance
You are solely responsible for buying travel insurance, and we require it. Your policy should cover trip cancellation and interruption, medical care, emergency evacuation, and the activities on your retreat, including surfing. Our payments are non refundable, so insurance is how you protect your money. We are not responsible for travel delays, missed flights or ferries, medical costs, or any extra costs caused by disruptions or emergencies.
11. Health and Medical
You confirm you are physically and mentally fit to take part. You must tell us in writing before the retreat about any injuries, medical conditions, allergies, medications, or pregnancy. Our hosts and instructors are not medical providers, and nothing at a retreat is medical advice. Many of our locations are remote, and medical care may be hours away. If you need emergency care and cannot decide for yourself, you authorize us to arrange treatment and transport at your expense.
12. Assumption of Risk
Our retreats include yoga, surfing, ocean swimming, snorkeling, boat and ferry travel, hiking, beach activities, and other physical practices. Taking part in every activity is voluntary. Surfing and ocean activities carry real risks, including falls, collisions, reef and rock contact, board injuries, marine life, currents, and drowning. Other risks include road and boat accidents, illness, foodborne illness, and limited medical access. These can result in serious injury, death, or property loss. You knowingly and willingly accept all of these risks, known and unknown.
13. Release of Liability
To the fullest extent the law allows, you release the following parties from all claims for injury, illness, death, accident, delay, loss, theft, or property damage connected to the retreat or to travel to and from it: Rena Palumbo Creations LLC, LUANA Retreats, Rena Palumbo, and our owners, hosts, staff, and contractors, along with every venue, resort, villa, and property we use and their owners, managers, and staff, surf schools, instructors, facilitators, boat and transport operators, sponsors, and partner organizations. You agree not to sue any of them for these claims. This release binds your family, heirs, and representatives.
14. Indemnification
You agree to cover and hold harmless all parties listed in section 13 against any claims, damages, and costs, including attorney fees, that arise from your actions, your breach of these terms, or damage you cause.
15. Third Party Suppliers
Venues, resorts, airlines, ferry and boat operators, drivers, surf schools, chefs, massage therapists, and other suppliers are independent businesses. We do not own or control them. We are not liable for their acts, omissions, or failures. Their own terms may also apply to you.
16. Food Allergies and Dietary Needs
You are responsible for telling us about any food allergies, restrictions, or sensitivities before the retreat. We and venue staff will make reasonable efforts to accommodate you. We cannot guarantee the absence of cross contamination or any specific dietary outcome.
17. Travel Documents and Flights
You are responsible for your passport, visas, vaccinations, and entry requirements. You are responsible for booking flights and arriving on time. We can't refund or hold transport for late arrivals. Do not book flights until we confirm your retreat in writing.
18. Conduct
LUANA is a respectful, supportive space. You agree to treat the property, hosts, staff, and other guests with respect and to follow all safety guidance. Illegal drugs are not allowed. We may remove any guest whose behavior puts herself, other guests, staff, or the venue at risk, or disrupts the group. No refund is given, and travel home is at your cost. You are responsible for any damage you cause.
19. Age
Guests must be 18 or older. A guest under 18 may attend only with our written approval and with a parent or legal guardian who accepts these terms and signs the Participant Agreement on her behalf.
20. Photo and Video
We photograph and film our retreats. You grant LUANA Retreats, Rena Palumbo, and our sponsors and brand partners permission to use photos, video, and audio that include you, along with any testimonial you give us. Uses include websites, social media, email, advertising, and partner marketing, worldwide, with no time limit and no payment owed to you. We may also repost retreat content you share publicly and tag us in. No images will be used in a harmful, misleading, or disrespectful way. If you prefer not to appear in content, email flow@luanaretreats.com before the retreat starts. We'll keep you out of published content as best we can.
21. Our Content
Our retreat materials, schedules, workshops, and written content belong to us. They are for your personal use only.
22. Personal Belongings
We are not responsible for lost, stolen, or damaged belongings, including surfboards, phones, and camera gear. You are responsible for damage to any rented equipment.
23. Limit of Liability
To the fullest extent the law allows, our total liability to you for any claim is limited to the amount you paid LUANA for your retreat. We are not liable for indirect or consequential losses, including lost wages, lost vacation time, or emotional distress.
24. Disputes and Governing Law
These terms are governed by the laws of the State of Hawaii. If a dispute comes up, you agree to first try to resolve it with us directly. Any dispute we can't resolve will be settled by binding arbitration in Honolulu, Hawaii, on an individual basis only. You waive any right to a jury trial or to join a class action. Either side may use small claims court instead.
25. General
If any part of these terms is found unenforceable, the rest stays in effect. These terms, plus the Participant Agreement you sign, are the entire agreement between us. If they conflict, the signed Participant Agreement controls. We may update these terms at any time. The version posted when you book applies to your booking. Checking a box, signing electronically, or making a payment counts as your signature.
